What Should You Expect From the Process?
Our firm handles approximately 1,000 DWI cases every year. We are experienced at guiding clients through each stage of the New York criminal defense process, including the following.
- Arrest: Whether or not you are taken to the station or held in jail, if the police try to stop you from leaving the scene, you have been arrested and must be read your rights.
- Arraignment: Your arraignment could be scheduled for anywhere from a day to a month after your arrest. This is where you are formally charged with DWI. Your driver's license can also be taken away at this point.
- Hardship hearing: After your arraignment, if your license has been taken, you can request a hearing within three days to ask for a hardship license.
- Investigation: Both the prosecutors and your defense attorney will have time to investigate the facts of your case and determine what their strategies will be.
- Plea negotiations: Depending on the circumstances of your case, the district attorney may agree to drop or reduce your charges, possibly in return for a promise to attend driver education classes or other conditions. This is also called pretrial disposition.
- Motions: Before your case goes to trial, your attorney can file motions to get test results, witness statements and other evidence against you excluded or suppressed. If these motions are successful, the charges may be dropped or reduced.
- Trial: About 5 percent of DWI cases go to trial. It is important to hire a law firm made up of seasoned New York criminal defense lawyers who are prepared to stand up for your rights in court if necessary.
The best way to protect your rights is to contact an attorney as early as possible. Our lawyers are on call 24/7 to discuss your charges.
