Under New York law, alcohol-related driving offenses are defined partially on the basis of the driver's blood alcohol content. While other evidence can be used to prove intoxication, BAC is often the most convincing proof. There are several different offenses associated with BAC.
- .02 is enough to violate the Zero Tolerance Law if you are under 21.
- .05 can get you charged with the crime of driving while ability impaired (DWAI).
- .08 is the threshold for the standard charge of DWI.
- .18 can increase your DWI penalties under the aggravated DWI statute.

How Is Blood Alcohol Content Determined?
